  • Can you design something for us simular to this? Open or Close

Many a times, clients come to us with a design carved in mind - probably of a competitor - and ask us to make something 'comparable' to it. The trouble begins (presuming we would) when we present our design proposals on the same pattern and the client starts comparing it to the 'inspired' resource. Now the mistakes that the client points out are not originally ours, but the faults are in the design that he wanted us to imitate. We guide our clients on an ethical level that imitating someone else's work is not the best way to go. We are convinced that they need to be unique and differentiable from their competitors.

  • I'm in Germany, your company in the Netherlands; how can we work with you? Open or Close

That's not a problem; we have clients in several countries, also outside Europe. Everything that you need to inspect, is put up on the web as it's worked on, also materials and communications move easily by our Online Client Area but also Skype, Emails, Faxes and Instant Messenger on a routine basis. Although we welcome our clients anytime to visit us physically, we have not met 90% of our customers in person. You don't need to meet us to convey your ideas, we have the expertise in this field to understand your requirements from top to bottom. The internet allows you to choose from the best web developers in the world and still get better, faster service than the agency across town can provide — and, after all, that's what you'll be using - the Web - to offer your own clients, isn't it?

On the Web, all distances are equal to zero. Even when someone chooses a local internet agency, it's unlikely that they will visit that company in person because of tight schedules, ending up talking on the phone and emailing. Working with your web developers and designers over the Internet is faster, more convenient, and more efficient than spending time arranging in-person meetings. Our company operates by the Virtual Office method, where our creatives and associates are connected through our Private Company Cloud. In the same way we work and communicate with our clients. • If we apply our brandname and/or logo online, must we register this content? Open or Close

Because it's very important to differentiate your business from your competition and protect your efforts doing so, you should always register your Logo's and/or brandname to prevent others from using it without your permission. You've invested time and money in developing your corporate or brand identity, so it needs to be protected. Whether it's used online or in the real world makes absolutely no difference.

To hear intellectual property attorneys describe it, it seems so simple. Copyright covers creative works of expression fixed into a tangible medium of expression. Trademark covers business names, slogans and other items used to identify it in the marketplace. Patent covers ideas and inventions. Logos are one of those spaces of intellectual property law where there is a great deal of overlap between two areas, in this case copyright and trademark, and businesses are known for using both to protect their logos from undesired use.

In order for a work to have copyright protection, it must reach a requisite level of creativity. Many logos, however, do not. Since copyright can't protect a name, colors or the design of the logo, most simple logos simply do not have the required level of creativity to be considered copyrightable. However, many ornate or artistic ones do.

So in order to make the right choice what kind of registration (Copyright ©/® or Trademark ™) is applicable to your logo or brandname, you should get informed by an attorney that is specialized in Intellectual Property Law. This will prevent you from a (legal) invalid logo or brandname registration, eventually ending up doing so would result in no intellectual property protection at all. Wouldn't it be a shame to discover such a major mistake during a legal battle with a competitor?
